DMCA Policy

Effective Date: 10 of July 2022

Flixara ("we," "our," or "us") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers.

1. Copyright Infringement Notification

If you believe that your copyrighted work has been copied or made accessible in a way that constitutes copyright infringement, please send us a written notification ("DMCA Notice") including the following information:

• Your full name, mailing address, telephone number, and email address.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., the URL or specific location on the Service).
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright.
• Your physical or electronic signature.

2. Submitting a DMCA Notice

We recommend that you consult with your legal advisor before filing a DMCA Notice, as false claims may result in legal consequences.

3. Counter-Notification

If you believe that your material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:

• Your full name, mailing address, telephone number, and email address.
• Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
• A statement that you consent to the jurisdiction of the federal district court in your judicial district, and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.
• Your physical or electronic signature.

4. Action Upon Receipt of a DMCA Notice or Counter-Notification

Upon receipt of a valid DMCA Notice, we will promptly remove or disable access to the allegedly infringing material and take reasonable steps to notify the user who posted it. Upon receipt of a valid counter-notification, we may restore the material unless the original complainant files an action seeking a court order against the user.

5. Repeat Infringers

We reserve the right to terminate the accounts or access of users who are deemed to be repeat infringers of copyrighted content.
